Yahaal Prime Terms Of Use
The special terms and conditions of Yahaal Prime (“Yahaal Prime Service”) managed and operated by Yahaal Company (“Yahaal” or “we”) apply to all users (“Users”, “you” or “you”) of the Yahaal application and its associated applications on iPhone, iPad, Android devices and mobile application platforms (hereinafter referred to as the “Yahaal App” or the “App”) who have subscribed to the Yahaal Prime service. o We will charge the Membership Fee to your chosen payment method at the time of signup. If your chosen payment method is declined for payment of your membership fees, you must provide a new, appropriate payment method immediately or your membership will be cancelled. If you provide a new eligible payment method and are charged successfully, your new membership term will be based on your original renewal date and not the date you were charged.

· Membership Cancellation:

You may not transfer or assign your membership in Yahaal Prime or any benefits, including promotional codes for Yahaal Prime memberships or its benefits, except as permitted by these terms.
Termination by us:
We may cancel your Yahaal Prime membership at our discretion and without notice.
We may terminate your Yahaal Prime Service immediately and without any prior notice, if we believe, in our sole discretion, that you are violating these Terms or any applicable law, such as committing fraud or abusing your Yahaal Prime membership, or otherwise harming our interests or the interest of another user.
INDEMNITY AND LIMITATION OF LIABILITY
You agree to defend, indemnify and hold Yahaal and its subsidiaries, officers, directors, employees, agents and representatives harmless from any and all claims, losses, liabilities, expenses, damages and costs (which include reasonable legal fees) arising or resulting directly or indirectly from or resulting from your breach of any of these Terms, or any activity you undertake in connection with the Application. Yahaal reserves the right, but is not obligated, to assume the exclusive defense and administration of any subject matter in dispute in which you may be entitled to indemnification, at its own expense. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, Yahaal DISCLAIMS ALL LIABILITY REGARDING THE BENEFITS, AND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Yahaal does not warrant that the features contained in the Yahaal Prime Service will be uninterrupted or error-free, that defects will be corrected, or that the Yahaal Prime Service or the server that makes it available are free of viruses or other harmful components.
To the maximum extent permitted by law, you will indemnify Yahaal, its officers and employees for all costs, expenses and damages incurred by you in connection with any claim brought by a third party against Yahaal resulting from your breach of any of the Terms. You acknowledge that the limitation/exclusion of Yahaal liability and your indemnification from Yahaal will also apply to all affiliated companies of Yahaal, including any parent company or subsidiaries.

You agree to cooperate with Yahaal to the fullest extent permitted by applicable law, including agreeing to answer in writing any questions or provide information necessary to assist Yahaal in conducting any internal investigation or inquiry.
Yahaal failure to enforce strict performance of any provision of the Terms will not constitute a waiver of its right to subsequently enforce that provision or any other provisions of the Terms.
Yahaal reserves the right to change the terms at any time and without notifying you of these changes. You agree that your continued use of Yahaal Prime Services constitutes your acceptance of the revised Terms, and your agreement that the revised version supersedes and replaces all previous versions of the Terms. You should review these Terms each time you use the Yahaal Prime Service for updates.
The headings contained in these terms are for ease of viewing only and do not affect the interpretation of these terms and conditions.
If any of these conditions are deemed void, invalid, or for any reason unenforceable, then that condition will be deemed severable and will not affect the validity and enforceability of the remaining conditions.
Our failure to exercise our rights under these Terms or our delay in exercising those rights under these Terms does not mean that we cannot exercise those rights later.
All notices and other communications under this Agreement shall be sent in writing by sending correspondence to the Yahaal email address shown in the Yahaal application.
Your use of the Yahaal Prime Service and these Terms shall be governed by and construed in accordance with the laws and regulations of the State of Kuwait. You agree that the courts of the State of Kuwait will have exclusive jurisdiction regarding these terms.
Yahaal Credit/Wallet
It is a service that allows the user to purchase balance on Yahaal via KNET and use this balance to provide the Yahaal service easily without the necessity of returning to the KNET payment portal every time users wish to pay via KNET.
The user may purchase Yahaal wallet credit for any desired amount.
Yahaal wallet balance is available to customers through the website or through smart phone applications/mobile internet channels.
Users may purchase credit for the Yahaal wallet only through the KNET payment gateway service available through Yahaal and through smart phone applications/mobile internet channels.
The User may only use Yahaal Wallet balance to pay for orders placed. The user can only benefit from this service if he registers an account with Yahaal.
The purchased balance/amount will always be available to the user via the “Wallet” page of each registered user.
The user may use the Yahaal wallet balance to pay for the order(s) that provide facilities. In the event that the remaining amount in the Yahaal wallet balance is insufficient to carry out the transaction, the user has the following options:
A- Increase the balance through the Yahaal wallet payment gateway to initiate the transaction.
B- Choose to exit the order(s) directly through K-Net
C- Choose to pay for the order(s) using another method.
The user may use his Yahaal wallet balance to purchase gift coupons.
Yahaal wallet balance is recoverable only for the amount that entered the wallet directly through the customer’s bank account and not in the event of compensation by the company, including, but not limited to, promotional offers and the like. The redemption request is made directly through the application via (the wallet page).
Your balance in the Yahaal wallet is not a credit facility and there is no interest on this balance.
No fees are charged against the Yahaal wallet balance.
The Yahaal wallet balance belongs only to the user who is the account owner and cannot be used by any person or entity other than the account holder.
Yahaal has the right to review the Yahaal wallet balance data for monitoring and internal reporting purposes and has the right to correct it in the event of any error.
Yahaal has the right to stop this service at any time without stating the reasons for doing so. However, all customer rights and credits are protected and preserved.
Yahaal wallet balance cannot be used after the expiry date which can be seen on the account page.
The Yahaal wallet balance purchased by the user expires after 180 days.
In the event that a Yahaal wallet balance is received as compensation, a new expiration date will be applied to the balance, with a period not exceeding 90 days, starting from the day the balance is received.
The user will be notified of the approaching expiration date via email.
Purchase vouchers/gifts
Purchasing vouchers/gifts is a service that enables users to purchase Yahal wallet balance and send this balance to a friend to carry out purchasing and payment operations online without the need to return to the KNET payment gateway.
Terms and Conditions:
The user may purchase gift vouchers for any desired amount.
Gift vouchers are available to customers through the website and through smart phone applications/mobile internet channels.
Users may purchase vouchers/gifts only through the KNET portal service or through available Yahaal wallet balance and through Yahaal smartphone applications/mobile internet channels.
Customers may purchase vouchers/gifts only if they register an account with Yahaal.
The registered user can purchase the specified vouchers/gifts after specifying the gift amount and after mentioning the name and phone number of the recipient. An email will be sent to both the buyer and the recipient as a special notification of this transaction.
If the recipient is not registered with Yahaal, the recipient of the gift vouchers must register to benefit from the gift vouchers after clicking on the confirmation link in the notification email. When you register an account, the gift vouchers will be automatically transferred to the Yahaal wallet balance with the same value as the gift voucher.
If the user has a Yahaal account, then when he clicks on the confirmation link in the notification email, the recipient will be able to see the gift coupon in his “Yahaal Wallet” and the gift vouchers will be automatically transferred to the Yahaal wallet balance with the same value as the gift coupon.
All terms and conditions of the Yahaal wallet balance apply to this service.
The buyer may not request a refund of the amount of purchase/gift vouchers upon completion of the transaction, except if the recipient does not use the gift voucher after one month from the date of purchase. In this case, the amount may be returned to the buyer.
If the amount of gift vouchers is returned (with the application of terms and conditions), the buyer must write an email request to: Support@Yahaal.com, and the refund process will be completed within 24 hours from the date of receipt of the request.
If the gift coupon is used by the beneficiary, the buyer or beneficiary cannot request a refund of the amount of the gift coupon that was purchased.
Yahaal has the right to review purchase/gift coupon data for internal monitoring and reporting purposes. You also have the right to correct any error.
There are no fees for purchase/gift coupons.
The Yahaal wallet balance is not a credit facility and there is no interest on this balance.

Restrictions for Non-Personal and Non-Commercial Use
You agree that the consequences of commercial use or re-publication of content or information of Yahaal may lead to serious and incalculable monetary compensation that may not be a sufficient or appropriate remedy and that Yahaal will be entitled to temporary and permanent injunctive relief to prohibit such use.
Product/Service delivery
During any product/service delivery process carried out, if the customer is not present at the address specified in the system, the products/services requested by the customer will not be delivered to any other place. In this case, the Member must accept all legal responsibilities arising from ordering to an address where they do not reside.
Product return
For returning the product, the product return conditions of partner suppliers apply. Yahaal does not bear any responsibilities for disputes that may arise from the product return conditions of partner suppliers.
Payment methods
1. The end customer can choose between different payment methods on the Yahaal website/application, which are currently: credit cards – debit cards – Apple Pay).
2. Yahaal has the right to provide any other payment methods that are not currently available, or to block any payment methods that are currently available.
3. In the event of payment via the Internet, the end customer is obligated to choose one of the payment methods available upon request, as online payments will be handled through online payment service providers.
4. Only if the customer agrees in advance to this, the online payment service providers will retain the customer’s card data for use in the event of a later order without the need to enter the credit card data at each payment process.
5. The customer is always obligated to ensure that the card balance is sufficient to pay the value of the order before placing the order.
